The Tax Regime for Non-Habitual Residents (RNH) in Portugal was reintroduced in 2024 under the new name of IFICI+, bringing significant adjustments to the conditions and tax benefits offered to expatriates and emigrants. IFICI+ maintains the objective of attracting international talent, while introducing specific criteria and notable exclusions.<\/p>

Comparison of the old and new tax programs :<\/b><\/p>

Conditions of Eligibility :<\/b><\/p>

-Old system: Open to tax residents who have not lived in Portugal in the five years preceding the application.<\/p>

-New program: Similar to the old program, but with a special focus on category A and B incomes.<\/p>

Tax rate :<\/b><\/p>

-Old system: Flat rate of 10% on pensions, exemption for passive income earned abroad.<\/p>

-New program: 20% rate on category A and B income, excluding dividends, capital gains and pensions.<\/p>

Exemption of passive income :<\/b><\/p>

-Old system: Exemption for capital income and capital gains earned abroad.<\/p>

-New program: Focuses on income from specific categories, limiting benefits to professional income.<\/p>

Exclusions :<\/b><\/p>

-Old system: Income earned in tax havens is not exempt.<\/p>

-New program: In addition to the restrictions of the old regime, specifically excludes dividends, capital gains and pensions to avoid international tax conflicts.<\/p>

It is aimed exclusively at qualified professionals carrying out specific activities in companies meeting strict criteria. The main eligible professions are defined in Annex I of Portaria n.\u00ba 352\/2024\/1:<\/p>\n

-Managing directors and executive managers<\/b>.<\/p>\n

-Administrative and sales managers<\/b>.<\/p>\n

-Production and specialized services managers<\/b>.<\/p>\n

-Specialists in physics, mathematics and engineering<\/b>.<\/p>\n

-University teachers<\/b>.<\/p>\n

-Information and communication technology specialists<\/b>.<\/p>\n

Specific requirements :<\/b><\/b><\/p>\n

To be eligible, these professions must be exercised within qualified companies, as defined in Appendix II of the same legal text. The companies concerned must belong to strategic sectors, such as :<\/p>\n

-Manufacturing industries.<\/strong><\/p>\n

-Information and communication technologies.<\/strong><\/p>\n

-Scientific research and development.<\/strong><\/p>\n

-Higher education and specialized medical activities.<\/strong><\/p>\n

In addition, these companies must :<\/p>\n

-Export at least 50 % of their sales<\/b> or,<\/p>\n

An application for non-habitual resident status takes approximately 4 weeks from the time we receive your documents to the time we complete the various legal requirements,<\/span>\u00a0mandatory before the tax exemption application procedure. <\/span><\/p>
